Mayfield still faces nine felony charges in three North Carolina counties.</p>
<p>The Iredell County charges stem from burglaries at Red Bull Racing and Fitz Motorsports. According to the indictment, $177,721 worth of  equipment was stolen from RBR, while an additional $20,000 worth of equipment was stolen from Fitz.</p>
<p>The <a href="http://lead-lap.com/2011/11/02/mayfield-arrested-on-possession-of-meth-charges/">Catawba County charges</a> include three charges for possession of stolen goods, one charge of obtaining property under false pretense and a methamphetamine possession charge.</p>
<p>He also faces four larceny charges in Caldwell County for stolen goods, which is unrelated to the race-team burglaries.</p>
<p>John Kavann Franklin was listed as a co-defendant in the case in Iredell. Franklin died following a police chase on Sept. 16. Reports indicated that Franklin had methamphetamines and scales in a compartment in his motorcycle.</p>
<p>Mayfield still faces a maximum penalty of 27 years in prison, though he is unlikely to get that sentence.</p>
<p>There have been rumors that Mayfield is considering a plea deal, but there has been no progress made there. Mayfield has refused to accept any plea deal that involves jail time.</p>
<p>Mayfield has been <a href="http://lead-lap.mikejsmith.net/2009/05/09/mayfield-suspended-indefinitely-by-nascar/">suspended from NASCAR</a> since May of 2009, when he failed a random drug test at Richmond International Raceway. Following the suspension, there was a lot of <a href="http://lead-lap.mikejsmith.net/2009/05/18/mayfield-may-not-be-telling-the-truth/">back and forth</a> between Mayfield and r. David Black, whose Aegis lab conducted the test.</p>
<p>Mayfield <a href="http://lead-lap.com/2009/06/02/mayfields-case-moved-to-federal-court/">sued NASCAR</a>, but his <a href="http://lead-lap.com/2010/05/18/judge-dismisses-mayfield-lawsuit/">case was dismissed</a>. His <a href="http://lead-lap.com/2012/03/28/u-s-court-of-appeals-panel-reject-mayfields-appeal/">appeal was also rejected</a>, and Mayfield <a href="http://lead-lap.com/2012/05/01/mayfield-says-he-will-drop-lawsuit-against-nascar/">decided to drop the suit</a>.</p>

According to the source, Allmendinger&#8217;s explanation is not consistent with the test results.</p>
<p>After failing the drug test, it was revealed that Allmendinger <a href="http://lead-lap.com/2012/08/09/allmendinger-tested-positive-for-adderall/">tested positive for Adderall</a>, a attention deficit hyperactivity disorder prescription drug. Because Allmendinger doesn&#8217;t have ADHD, he did not have a prescription for the drug. After Jeremy Mayfield&#8217;s initial failed drug test, he <a href="http://lead-lap.mikejsmith.net/2009/05/11/mayfield-issues-statement-about-suspension/">blamed it on a combination of Claritan and Adderall</a>.</p>
<p>If Adderall were ingested one time, it is highly unlikely that it would show up in one&#8217;s system after 24 hours. Allmendinger was tested two days after he claims to have taken the pill.</p>
<p>But, Dr. Don Catlin, co-founder and president of Anti-Doping Research &amp; Support Clean Sport and founder and the former director of the UCLA Olympic Analytical Lab, said that in general Adderall would show up in one&#8217;s urine for a couple of days. But, he did not know the specific details of Allmendinger&#8217;s case, nor did he know the dosage of the pill or the level of sensitivity of the testing equipment.</p>
<p>The source also said that Allmendinger did not reveal that he took anything that might trigger a positive test to the medical review officer during the standard questioning during the test. This alone, however, does not mean Allmendinger&#8217;s explanation is not true, as he may have not mentioned the pill because he didn&#8217;t think of it, or he thought he&#8217;d be okay.</p>
<p>Still, Dr. David Black, who runs Aegis Sciences Corp., which runs the testing program, said in response to Allmendinger&#8217;s explanation:</p>
<blockquote><p>Certainly, if that had been a possibility (it) would have been ruled out before any action was taken. On every positive test we have, we look to rule out the possibility of a supplement being involved. I&#8217;m not aware of any commercial products that would have influenced the test outcome.</p></blockquote>

<p>Per Allmendinger&#8217;s account of the details, he says that a friend gave him a pill before the Quaker State 400 race at Kentucky Speedway that his friend said was a workout supplement that would give him energy. He took it. Two days later, he was selected as part of a random drug test.</p>
<p>Allmendinger is currently participating in NASCAR&#8217;s Road to Recovery program, which, once completed, will allow him to be reinstated.</p>
<p>Since his suspension, he has been <a href="http://lead-lap.com/2012/08/01/penske-racing-releases-allmendinger/">released by Penske Racing</a>.</p>
<p>Ironically, Adderall is one of the medicines Jeremy Mayfield <a href="http://lead-lap.mikejsmith.net/2009/05/11/mayfield-issues-statement-about-suspension/">claimed caused his failed drug test back in 2009</a>. Mayfield, however, said that his Adderall (which, he claimed, was when combined with over-the-counter Claritan, what caused him to fail his drug test) was prescribed for ADHD.</p>

				<content:encoded><![CDATA[<p><a href="http://lead-lap.com/wp-content/uploads/2012/05/allmendinger2012a.jpg"><img class="alignright size-full wp-image-7893" title="allmendinger2012a" src="http://lead-lap.com/wp-content/uploads/2012/05/allmendinger2012a.jpg" alt="AJ Allmendinger during qualifying for the NASCAR Sprint Cup Series STP 400 at Kansas Speedway on April 21, 2012 in Kansas City, Kansas." width="350" height="223" /></a>Ninety minutes before the Coke Zero 400 at Daytona International Speedway, NASCAR announced that AJ Allmendinger, driver of Penske Racing&#8217;s No. 22 Dodge, had been suspended for violating NASCAR&#8217;s substance abuse policy. Following the race at Kentucky Speedway, Allmendinger was selected for a random drug test. His &#8220;A&#8221; sample tested positive, though it has not been revealed for what he had tested positive.</p>
<p>Allmendinger&#8217;s suspension is currently temporary. He has requested that his &#8220;B&#8221; sample be tested. The sample will take five days to complete. Aegis Sciences Corporation, which performed the first test, will conduct the test on Allmenginder&#8217;s second sample. If that sample comes back positive, then his suspension will become indefinite.</p>
<p>Sam Hornish replaced him in the No. 22 for the race at Daytona, and will fill in for Allmendinger at New Hampshire Motor Speedway in the LENOX Industrial Tools 301.</p>
<p>NASCAR issued an official announcement:</p>
<blockquote><p>Driver AJ Allmendinger has been temporarily suspended from NASCAR competition based upon notification of a positive &#8220;A&#8221; test NASCAR received from the Medical Review Officer as stated in Section 19-11B (6,7) of the NASCAR Substance Abuse Policy.</p></blockquote>
<p>Penske Racing issued a statement following the announcement:</p>
<blockquote><p> NASCAR notified Penske Racing this afternoon that AJ Allmendinger was administered a drug test earlier this week, and those results tested positive. NASCAR has a strict drug testing program that Penske Racing fully supports. Penske Racing will work with NASCAR through this process and its next steps.</p></blockquote>
<p>Penske Racing owner Roger Penske called the failed drug test a &#8220;disappointment&#8221; but indicated that he would reserve judgment until the &#8220;B&#8221; sample was tested.</p>
<p>He said:</p>
<blockquote><p>You know it&#8217;s a disappointment at this particular time, but we&#8217;re going to wait and see what the second test results are before we make any comment or decisions. I don&#8217;t think it&#8217;s fair to him. I think as you look at sports, things happen like this. It&#8217;s unfortunate, but I don&#8217;t really want to make a statement pro or con right now. I&#8217;m counting on another test being proper for him within 72 hours, and at that point we&#8217;ll make a decision.</p></blockquote>
<p><del>Allmendinger has remained silent on the issue and no statements have been issued.</del> <em>[See update below]</em> His business manager, Tara Ragan, however did say that they were &#8220;shell-shocked&#8221; in regards to the test.</p>
<p>Allmendinger is the first big-name driver to fail a random NASCAR drug test since<a href="http://lead-lap.com/2009/05/09/mayfield-suspended-indefinitely-by-nascar/"> Jeremy Mayfield failed a test</a> that resulted in a long court battle that <a href="http://lead-lap.com/2012/05/01/mayfield-says-he-will-drop-lawsuit-against-nascar/">recently ended</a> between Mayfield and NASCAR. Aegis also conducted that test.</p>
<p>This is not Allmendinger&#8217;s first brush with trouble. In 2009, Allmendinger was <a href="http://lead-lap.com/2009/10/29/allmendinger-arrested-for-dwi/">arrested for driving while intoxicated</a>. He<a href="http://lead-lap.com/2009/12/22/allmendinger-pleads-no-contest-to-dwi/"> pleaded no contest</a> and received probation and community service. Richard Petty Motorsports, his then-team, also placed him on probation and fined him $10,000. Allmendinger did, however, take full responsibility for the incident.</p>
<p><strong>Update: </strong>AJ Allmendinger has issued a statement regarding his failed drug test:</p>
<blockquote><p>I fully respect NASCAR’s drug usage policy and the reasons they have it. I am hoping this can get resolved as quickly as possible so that I can get back to driving the No. 22 Penske Racing Dodge. I am sorry that this has caused such a distraction for my Penske Racing team, our sponsors and fans. Obviously I would never do anything to jeopardize my opportunity here at Penske Racing or to my fellow drivers. I am very conscious about my training and health and would never knowingly take a prohibited drug.</p></blockquote>
<p><strong>Update 2:</strong> Tara Ragan, Allmendinger&#8217;s business manager also issued a statement:</p>
<blockquote><p>In an effort to help our colleagues in the media report on this in a timely and accurate manner, we wanted to provide some additional details regarding AJ&#8217;s sample &#8220;A&#8221; test results. AJ tested positive for a stimulant. He has no idea why the first test was positive, and he has never knowingly taken any prohibited substance. AJ is collecting his medicines and supplements for testing to determine whether an over-the-counter product caused his positive test. AJ and all of us at Walldinger Racing respect NASCAR&#8217;s testing program, and he has requested that his &#8220;B&#8221; sample be tested as part of the process of getting to the bottom of this. We will have the opportunity to review all of the scientific data surrounding the test following the &#8220;B&#8221; sample test, but our understanding is that AJ&#8217;s test was slightly above the threshold.</p></blockquote>

<p>A US District Court judge <a href="http://lead-lap.com/2010/05/18/judge-dismisses-mayfield-lawsuit/">dismissed Mayfield&#8217;s case</a> in May 2010, and Mayfield&#8217;s appeal was <a href="http://lead-lap.com/2012/03/28/u-s-court-of-appeals-panel-reject-mayfields-appeal/">rejected earlier this year</a>.</p>
<p>Mayfield also faces four counts of felony larceny stemming from a February indictment that states he was in possession of stolen property.</p>
<p>Mayfield also recently lost his home to foreclosure. He has 10 days to move out of the house, and may still be forced to pay $500,000.</p>
<p>The 400-acre property was sold at auction and Carolina Farm Credit, the bank that made the loan to Mayfield, was the only bidder. Another buyer has 10 days to make an offer. If no other offer is made, Mayfield must leave the premises on May 10.</p>

				<content:encoded><![CDATA[<p><a href="http://lead-lap.com/wp-content/uploads/2010/05/mayfield1.jpg"><img class="alignright size-full wp-image-3200" title="mayfield1" src="http://lead-lap.com/wp-content/uploads/2010/05/mayfield1.jpg" alt="" width="350" height="223" /></a>A U.S. Court of Appeals panel has rejected the appeal of Jeremy Mayfield&#8217;s lawsuit against NASCAR over a 2009 failed drug test that resulted in his indefinite suspension from NASCAR competition, according to <a href="http://www.scenedaily.com/news/articles/sprintcupseries/Jeremy_Mayfield_loses_appeal_to_US_Court_of_Appeals.html">SceneDaily.com</a>.</p>
<p>The three judge panel ruled on Monday that U.S. District Court Judge Graham Mullen&#8217;s was correct when he dismissed all of Mayfield&#8217;s claims against NASCAR.</p>
<p>Judge Roger Gregory wrote:</p>
<blockquote><p>With respect to the breach of contract and unfair and deceptive trade practices claims, the liability waivers preclude recovery. As for the new defamation allegations and the new additional tort claims, we find that permitting (Mayfield) to amend their complaint would be prejudicial to (NASCAR).</p></blockquote>
<p>NASCAR issued a statement saying they were pleased with the result.</p>
<p>Mayfield can appeal to all of the judges of the U.S. Courth of Appeals Fourth Circuit. The next step would be an appeal to the U.S. Supreme Court.</p>
<p>Mayfield <a href="http://lead-lap.com/2009/05/09/mayfield-suspended-indefinitely-by-nascar/">failed a drug test</a> in May of 2009 and was subsequently suspended indefinitely by NASCAR. He <a href="http://lead-lap.com/2009/05/11/mayfield-issues-statement-about-suspension/">claimed</a> that the positive test result was due to a combination of  prescribed medicine (Adderall) and an over-the-counter medicine (Claritan).</p>
<p>David Black, whose Aegis Labs ran NASCAR’s random testing program and conducted the test, <a href="http://lead-lap.com/2009/05/11/nascar-drug-tester-disputes-mayfields-claim/">disputed Mayfield&#8217;s claim</a>. He called it a &#8220;clear violation of policy.&#8221;</p>
<p>At the time of the failed test, the substance for which Mayfield tested positive was not made public. As a result, drivers and fans wondered what Mayfield tested positive for. NASCAR eventually <a href="http://lead-lap.com/2009/05/22/nascar-calls-mandatory-drivers-meeting/">called a mandatory drivers meeting</a> to clear up confusion.</p>
<p>Mayfield <a href="http://lead-lap.com/2009/06/02/mayfields-case-moved-to-federal-court/">filed suit</a> to get reinstated, and NASCAR subsequently <a href="http://lead-lap.com/2009/06/06/nascar-countersues-mayfield/">filed a countersuit</a> claiming Mayfield willfully violated NASCAR&#8217;s substance abuse policy. Shortly thereafter, <a href="http://lead-lap.com/2009/06/09/mayfield-tested-positive-for-meth-sources-say/">reports began surfacing</a> that Mayfield tested positive for methamphetamine, a claim Mayfield has staunchly denied. An independent lab <a href="http://lead-lap.com/2009/06/30/independent-lab-confirms-mayfield-test-result/">confirmed Mayfield&#8217;s positive test</a>.</p>
<p>Eventually, Mayfield <a href="http://lead-lap.com/2009/07/01/mayfield-wins-injunction-nascar-can-appeal/">won an injunction</a> to return to racing but the damage was already done. Mayfield Motorsports Inc. was being <a href="http://lead-lap.com/2009/06/17/trt-bdr-acquisitions-suing-mmi/">sued by Triad Racing Technologies and BDR Acquisitions</a> over nonpayment for equipment and labor. He was rumored to have sold the team.</p>
<p>Mayfield was also <a href="http://lead-lap.com/2009/07/09/nascar-mayfield-disagree-on-monday-test/">tested again</a> and <a href="http://lead-lap.com/2009/07/16/mayfield-again-tests-postive-for-meth/">reportedly failed</a>. NASCAR then <a href="http://lead-lap.com/2009/07/24/nascar-wins-appeal-of-mayfield-injunction/">won its appeal of Mayfield&#8217;s injunction</a> to return to racing, and sought to get the injunction <a href="http://lead-lap.com/2009/07/28/nascar-wants-mayfield-injunction-thrown-out-permanently/">permanently thrown out</a>. They were<a href=" http://lead-lap.com/2009/09/02/judge-denies-request-to-lift-mayfield-injunction/ "> unsuccessful</a>, however.</p>
<p>A little over a year after Mayfield failed the first drug test, Judge Mullen <a href="http://lead-lap.com/2010/05/18/judge-dismisses-mayfield-lawsuit/">dismissed all of his claims against NASCAR</a>. He asked the judge to reconsider.</p>
<p>Things got worse for Mayfield as he was <a href="http://lead-lap.com/2011/11/02/mayfield-arrested-on-possession-of-meth-charges/">arrested</a> in November of 2011 for possession of methamphetamines and stolen property. He has been indicted on four felony counts of larceny, three counts of possession of stolen goods and one of obtaining property on false pretenses. His court date for those charges is Apri 2, 2012.</p>

				<content:encoded><![CDATA[<p><a href="http://lead-lap.com/wp-content/uploads/2010/05/mayfield1.jpg"><img class="alignright size-full wp-image-3200" title="mayfield1" src="http://lead-lap.com/wp-content/uploads/2010/05/mayfield1.jpg" alt="" width="350" height="223" /></a>Former NASCAR driver Jeremy Mayfield has been arrested on drug charges, according to <a href="http://www.wbtv.com/story/15934052/nascar-driver-arrested-on-drug-charges">WBTV</a>. Mayfield was arrested for possession of methamphetamine in his home in the town of Catawba. Deputies from Catawba County were at Mayfield&#8217;s home executing a search warrant on a tip that stolen goods were on the property. That search produced methamphetamines. They also found some items that may or may not be stolen. Mayfield is out on $3,000 bond and is scheduled to appear in court today.</p>
<p>Mayfield has been suspended from NASCAR since May of 2009, when he <a href="http://lead-lap.com/2009/05/09/mayfield-suspended-indefinitely-by-nascar/">failed a random drug test</a> at Richmond International Raceway. In a <a href="http://lead-lap.com/2009/05/11/mayfield-issues-statement-about-suspension/">statement</a> follwing the test, Mayfield blamed it on &#8221;the combination of a prescribed medicine and an over the counter medicine [that] reacted together and resulted in a positive drug test.&#8221;</p>
<p>Dr. David Black, whose Aegis lab conducted the test, disputed Mayfield&#8217;s claim, saying:     </p>
<blockquote><p>What we have is a clear violation of policy. … In my many years of experience, I have never seen a violation like this due to the combination of over-the-counter or prescription products.</p></blockquote>
<p>This touched off a storm of back and forth between Mayfield, Black, and NASCAR. Mayfield claimed that Black <a href="http://lead-lap.com/2009/05/19/mayfield-was-informed-of-substance-black-says/">never informed him of the the drug for which he tested positive</a>, but Black claimed that he had a discussion with Mayfield.</p>
<p>Mayfield then <a href="http://lead-lap.com/2009/05/20/mayfield-lawyers-up/">hired a lawyer</a> and sued NASCAR. His case was <a href="http://lead-lap.com/2009/06/02/mayfields-case-moved-to-federal-court/">moved to federal court</a>. NASCAR <a href="http://lead-lap.com/2009/06/06/nascar-countersues-mayfield/">countersued</a>.   </p>
<p>Documents in the case revealed sources that confirmed that Mayfield <a href="http://lead-lap.com/2009/06/09/mayfield-tested-positive-for-meth-sources-say/">tested positive for methamphetamines</a>. An independent lab later <a href="http://lead-lap.com/2009/06/30/independent-lab-confirms-mayfield-test-result/">confirmed it</a>. In July of 2009, Mayfield <a href="http://lead-lap.com/2009/07/01/mayfield-wins-injunction-nascar-can-appeal/">won an injunction</a> allowing him to return to the Sprint Cup garage, but he never did as he did <a href="http://lead-lap.com/2009/07/10/mayfields-may-sell-team/">not have funding</a>. NASCAR later had the <a href="http://lead-lap.com/2009/07/24/nascar-wins-appeal-of-mayfield-injunction/">injunction overturned</a>.</p>
<p>One year after the whole thing started, a judge <a href="http://lead-lap.com/2010/05/18/judge-dismisses-mayfield-lawsuit/">dismissed Mayfield&#8217;s lawsuit</a>. Judge Graham Mullen wrote:</p>
<blockquote><p>Plaintiffs (Mayfield) agreed to release Defendants from all claims arising under a negligence theory or otherwise; Plaintiffs thereby waived their right to pursue their claims for defamation, unfair and deceptive trade practices, breach of contract, and negligence. Plaintiffs also failed to allege facts to support each of their claims. … Plaintiffs claims are hereby dismissed.</p></blockquote>
<p>Mayfield <a href="http://lead-lap.com/2010/06/17/mayfield-asks-judge-to-reconsider-dismissal-of-his-claims/">asked the judge to reconsider</a>, claiming that Mullen made a mistake by allowing NASCAR’s countersuit against Mayfield for breach of contract to proceed while dismissing his suit. The motion also argues that the judge did not give Mayfield the opportunity to amend his complaint to bring claims of wrongful interference with contractual or business relations. It also argues that the correct Florida law was not applied. In October of 2010, he also <a href="http://lead-lap.com/2010/10/01/mayfield-claims-nascar-officials-disliked-him/">brought new charges to light</a>, claiming that NASCAR illegally interfered with his business, and had personal malice against him.</p>

Mayfield&#8217;s request of the judge to reconsider is a part of the process before actually filing an appeal with the US Court of Appeals.</p>
<p>In addition to having his suit reinstated, Mayfield also brought new claims to light, which he says shows NASCAR illegally interfered with his business, and had personal malice against him &#8212; specifically NASCAR Chairman Brian France. Mayfield requested to have those claims added to his suit.</p>
<p>Mayfield claims that in 2006, France had him black flagged during the Brickyard 400 at Indianapolis Motor Speedway. The allegations stem from affidavits in which former in-laws of France&#8217;s said that he called NASCAR President Mike Helton during the race and asked him to black flag Mayfield. The affidavits were part of a suit between France and his former in-laws, as he was attempting to evict them from a house he owned.</p>
<p>Mayfield alleges that once he pitted, his car was never looked over.</p>
<p>That race is important because Mayfield hit the wall and finished 41st, which Ray Evernham said Mayfield did in purpose. He was released a few days later, which led him to accuse Evernham of being more focused on other teams than others in his organization &#8211; a shot at his girlfriend Erin Crocker, who drove for him at the time.  </p>
<p>Additionally, Mayfield claims that NASCAR was upset with him for signing SmallSponsor.com. The sponsor chose to market itself through a deal with Mayfield Motorsports Inc&#8217;s No. 41 Toyota. But, Mayfield&#8217;s filing states that NASCAR was courting them to sponsor tracks and races.</p>
<p>NASCAR spokesman Ramsey Poston denied Mayfield&#8217;s claims:</p>
<blockquote><p>Mayfield’s claims are blatantly false and Jeremy and his lawyers know it. In fact, prior to their filing we notified Mayfield’s lawyers that the allegations were completely baseless and that we had evidence to prove the falsity of the claims. Mayfield and his lawyers chose to continue a campaign of lies and disregard the evidence that was discussed with them.</p></blockquote>
<p>In 2009, Mayfield failed a drug test and was <a href="http://lead-lap.com/2009/05/09/mayfield-suspended-indefinitely-by-nascar/">suspended indefinitely</a> by NASCAR for violating the substance abuse policy. In a <a href="http://lead-lap.com/2009/05/11/mayfield-issues-statement-about-suspension/">statement</a>, he claimed that the test was the result of a combination of a prescribed medicine and an over-the-counter medicine. <p>But Mayfield is arguing, according to <a href="http://www.scenedaily.com/news/articles/sprintcupseries/Jeremy_Mayfield_asks_court_to_reconsider_decision_to_dismiss_his_claims_against_NASCAR.html">SceneDaily.com</a>, is that Mullen made a mistake by allowing NASCAR’s countersuit against Mayfield for breach of contract to proceed while dismissing his suit. The motion also argues that the judge did not give Mayfield the opportunity to amend his complaint to bring claims of wrongful interference with contractual or business relations. It also argues that the correct Florida law was not applied.</p>
<p>Shortly before the case was dismissed, Mayfield’s attorney’s <a href="http://lead-lap.com/2010/05/14/gordon-johnson-subpoenaed-in-mayfield-lawsuit/">subpoenaed Jeff Gordon and Jimmie Johnson</a> to depose them in regard to sworn statements they made about his lawsuit. It is unclear at this point whether or not they will be deposed in the event that Mayfield&#8217;s case is reinstated.</p>
<p>In May 2009, Mayfield was <a href="http://lead-lap.mikejsmith.net/2009/05/09/mayfield-suspended-indefinitely-by-nascar/">suspended for violating NASCAR’s substance abuse policy</a>. At the time, Mayfield claimed the failed drug test was the result of the <a href="http://lead-lap.mikejsmith.net/2009/05/11/mayfield-issues-statement-about-suspension/">combination of a prescribed medicine and an over the counter medicine</a> that reacted together. He later said that the mix was of Adderall RX, which he said he was prescribed for attention deficit hyperactivity disorder, and Claritin. David Black, whose Aegis Labs runs NASCAR’s random testing program, <a href="http://lead-lap.com/2009/05/11/nascar-drug-tester-disputes-mayfields-claim/">disputed that claim</a>.</p>
<p>Mayfield later sued NASCAR challenging the suspension. He was hoping to get a temporary restraining order that would allow him to return to the track while the suit was ongoing. That request was denied.</p>
<p>In response, <a href="http://lead-lap.mikejsmith.net/2009/06/06/nascar-countersues-mayfield/">NASCAR filed a countersuit</a> against Mayfield accusing him of willfully violating NASCAR’s substance abuse policy, breaching his contract, and defrauding competitors of earnings. The suit contends that Mayfield was under the influence during races, and in those races won more than $150,000 that would have gone to other competitors.</p>
<p>In July of last year, Mayfield was <a href="http://lead-lap.mikejsmith.net/2009/07/01/mayfield-wins-injunction-nascar-can-appeal/">granted an injunction</a>, allowing him to return to the Sprint Cup Series. But he never returned to the track. But less than a month later, <a href="http://lead-lap.com/2009/07/24/nascar-wins-appeal-of-mayfield-injunction/">NASCAR got Mayfield’s injunction overturned</a>. NASCAR attempted to get Mayfield’s injunction <a href="http://lead-lap.com/2009/07/28/nascar-wants-mayfield-injunction-thrown-out-permanently/">thrown out permanently</a>, but that request was <a href="http://lead-lap.com/2009/09/02/judge-denies-request-to-lift-mayfield-injunction/">denied in September</a>.</p>
<p>Since then, things were relatively quiet until Mayfield subpoenaed Gordon and Johnson.  Shortly after that, his case was dismissed.</p>

Late last year, NASCAR filed a motion that sought to get the case dismissed based on pleadings already submitted.</p>
<p>On Tuesday afternoon, Mullen dismissed the case without holding a hearing.</p>
<p>In his order, Judge Mullen wrote:</p>
<blockquote><p>Plaintiffs (Mayfield) agreed to release Defendants from all claims arising under a negligence theory or otherwise; Plaintiffs thereby waived their right to pursue their claims for defamation, unfair and deceptive trade practices, breach of contract, and negligence. Plaintiffs also failed to allege facts to support each of their claims. &#8230; Plaintiffs claims are hereby dismissed.</p></blockquote>
<p> This news comes days after Mayfield&#8217;s attorney&#8217;s subpoenaed Jeff Gordon and Jimmie Johnson to depose them in regard to sworn statements they made about his lawsuit.</p>
<p>Mayfield can appeal to the U.S. Court of Appeals.</p>
<p>NASCAR issued a statement regarding the ruling:</p>
<blockquote><p>The U.S. District Court&#8217;s ruling is a powerful acknowledgment and affirmation of NASCAR&#8217;s rulebook and its ability to police the sport. NASCAR has been very clear with its competitors as to its policies and what is expected of them. NASCAR&#8217;s comprehensive substance abuse policy, which is among the best and toughest in all of sports, serves the safety of our competitors and fans.</p></blockquote>
<p>The Mayfields nor their attorney have issued a statement at this point.</p>
<p>Mayfield was <a href="http://lead-lap.mikejsmith.net/2009/05/09/mayfield-suspended-indefinitely-by-nascar/">suspended</a> in May of last year for violating NASCAR&#8217;s substance abuse policy. <p>He later sued for breach of contract, discrimination and defamation in an attempt to get back on the track and for financial damages. He <a href="http://lead-lap.mikejsmith.net/2009/07/01/mayfield-wins-injunction-nascar-can-appeal/">won an injunction</a> to return to the track. But, despite that, he never returned.</p>
<p>NASCAR <a href="http://lead-lap.mikejsmith.net/2009/07/24/nascar-wins-appeal-of-mayfield-injunction/">won an appeal</a> of the injunction, giving them the right to suspend Jeremy Mayfield for his failed drug test until an appeal of the ruling was to be heard. A trial was scheduled for later this year.</p>
